Welcome to the mobile applications, games, and digital services provided by Beijing Hongdu Tengyu Technology Co., Ltd. ("Hongdu Tengyu", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms of Service.

1. Acceptance of Terms and Binding Agreement

1.1 Contractual Binding Nature. This Agreement constitutes a legally binding instrument executed between Hongdu Tengyu and the User. Your affirmative act of accessing, downloading, or utilizing the Services shall be deemed a conclusive manifestation of your intent to be bound by the totality of the provisions set forth herein.

1.2 Affirmative Manifestation. Continued utilization of the Services following any published update constitutes an express and informed ratification of the revised Terms.

1.3 Modifiability. The Company reserves the unilateral and absolute prerogative to modify or restate these Terms at any time without prior individual notice.

2. Eligibility, Legal Capacity, and Global Age Management

2.1 Legal Capacity. You warrant that you possess the requisite legal capacity to enter into a binding contract under your local jurisdiction's laws.

2.2 Minor Protection. In accordance with COPPA and GDPR-K, the Services are strictly prohibited for individuals under the age of thirteen (13). Verification of age is mandatory for specific social and monetization features.

3. Grant of a Limited, Non-Exclusive License to Services

Hongdu Tengyu hereby grants you a personal, non-exclusive, non-transferable, revocable, and limited license to access and use the Services solely for your personal, non-commercial entertainment purposes. This license is strictly contingent upon your continuous compliance. We reserve the right to revoke this license at any time, with or without cause.

4. Account Registration, Security, and User Credentials

You are solely responsible for the safeguarding of your account credentials. Any activities conducted through your account shall be legally attributed to you. You agree to notify the Company immediately of any unauthorized access. The Company expressly disclaims any liability for losses incurred due to compromised account credentials resulting from User negligence.

5. User Conduct, Prohibited Activities, and Bug Exploitation

The User represents and covenants that they shall not engage in any activity that undermines the integrity of the Services, including but not limited to:

  • Reverse Engineering: Any attempt to decompile, disassemble, or derive the source code of the Company's proprietary software.
  • Automated Cheating: The use of bots, macros, hacks, or unauthorized third-party software to modify gameplay.
  • Bug Exploitation: Utilizing technical glitches or "bugs"—especially within the "Strategy Minesweeper" mechanics—to obtain virtual assets without authorized purchase.
  • Real-World Trading: Engaging in the sale of accounts or virtual items for fiat currency.

6. Virtual Items and In-Game Assets

6.1 License, Not Ownership. All virtual items within the "Red/Blue Ball Simulation" and "Strategy Minesweeper" ecosystems are digital artifacts licensed to you. They possess no real-world monetary value and constitute no property interest.

6.2 Absolute Discretion. Hongdu Tengyu reserves the absolute right to manage, regulate, control, modify, or eliminate virtual items at any time without liability.

7. In-App Purchases (IAP) and VIP Membership Systems

All financial transactions are conducted through the Apple App Store or Google Play Store billing systems. VIP memberships provide incremental, non-exclusive benefits that vary by tier. Pricing is subject to dynamic adjustment based on market conditions and regional Purchasing Power Parity (PPP).

8. Comprehensive Subscription and Refund Policy

8.1 Finality of Sale: Subject to mandatory local consumer laws, all purchases of Virtual Items and Subscriptions are FINAL AND NON-REFUNDABLE.

8.2 Subscription Management: Subscriptions automatically renew. You must cancel at least 24 hours before the renewal date via platform account settings to avoid subsequent charges.

8.3 Platform Disputes: For refund requests mandated by law, Users must contact the respective App Store support directly.

9. Third-Party Advertising and Data Sharing

The Services integrate advertising modules, specifically Google AdMob and AppLovin MAX. By utilizing the Services, you acknowledge that technical telemetry (IDFA, AAID) may be shared with these partners to facilitate targeted advertising.

10. Intellectual Property Rights and Proprietary Content

All titles, computer code, game mechanics, artwork, characters, and musical compositions are the exclusive property of Hongdu Tengyu or its licensors. Unauthorized reproduction is strictly prohibited and will be prosecuted to the maximum extent of international law.

11. User Content and Feedback License

By providing nicknames or feedback, you grant the Company a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, and modify such content for any commercial purpose without compensation.

12. Disclaimer of Warranties: The "As-Is" Provision

HONGDU TENGYU PROVIDES THE SERVICES ON AN "AS IS" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ERROR-FREE OPERATION.

13. Strict Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL AGGREGATE LIABILITY SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY THE USER DURING THE SIX (6) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

14. Indemnification and Hold Harmless

You agree to defend and hold Hongdu Tengyu harmless from any and all claims, damages, liabilities, and expenses arising from your use of the Services or your breach of this Agreement.

15. Governing Law, Dispute Resolution, and Severability

This Agreement shall be governed by the laws of the People's Republic of China. Any dispute shall be submitted to the Beijing Arbitration Commission (BAC) for binding arbitration in accordance with its rules.
